On July 12, we finally landed the published version of Regulation (EU) 2024/1689 of the European Parliament and of the Council of 13 June 2024 laying down harmonised rules on artificial intelligence and amending Regulations (EC) No 300/2008, (EU) No 167/2013, (EU) No 168/2013, (EU) 2018/858, (EU) 2018/1139 and (EU) 2019/2144 and Directives 2014/90/EU, (EU) 2016/797 and (EU) 2020/1828 (Artificial Intelligence Act)Text with EEA relevance.
The European Union (EU) AI Act is now officially published in the EU Official Journal. This will be the version to download and reference going forward.
Best Practices
For individuals or companies that are deploying or implementing AI systems (referred to as “deployers” under the Act), here are three key obligations to keep in mind:
🔥 Implement a risk assessment system;
🔥 Adopt transparency principles and processes; and
🔥 Design responsible AI governance.
📆 Here are some key dates to know:
📌 August 1, 2024 (in a matter of days!): the EU AI Act goes into effect.
📌 February 2, 2025: The list of prohibited uses goes into effect (these include: social scoring, manipulation, exploiting vulnerabilities, risk assessment/predicting criminal offenses, compiling facial recognition databases from public/CCTV sources, real-time biometric analysis)
📌 May 2, 2025: Code of practices made available for providers of general-purpose AI (GPAI) models (which is going to be a hot-button issue as these gets finalized).
📌 August 2, 2025: GPAI providers must be in compliance with provision of the Act; also, a robust (complex?) governance structure will have to be in place that addresses stakeholders at the national and EU levels.
📌 February 2, 2026: Commission must provide guidelines specifying the practical implementation of the Act and a comprehensive list of practical examples of use cases of AI systems that are high-risk and not high-risk.
📌 August 2, 2026: The Act is fully applicable! Deadline by which the infrastructure related to the governance and the conformity assessment system should be operational.
📌 August 2, 2027: There’s a little more time for some high-risk AI systems. See Article 6(1) for the criteria, but mainly if they’re designed to be used as a safety component of a product, or if there’s a third-party conformity assessment requirement.
